First Steps

  1. A U.S. citizen files a petition regarding the relationship

  2. The foreign relative then applies for permanent residence within the US, or at a consulate or embassy if they are located outside of the US.


Visas for Immediate Family Members
U.S. citizens and lawful permanent residents have the opportunity to sponsor eligible family members for immigration to the United States. This includes spouses, unmarried children under 21, parents, widows if within 2 years of the death of the spouse, and other qualifying relatives.

Visas Based on Family Preference

Family Preference visas are available for certain relatives of U.S. citizens and lawful permanent residents (green card holders). These visas are subject to annual numerical limits, which can result in significant wait times.

Visa Categories:

  • First Preference: Unmarried sons and daughters (over 21) of U.S. citizens, along with their spouses and any minor children.

  • Second Preference: Spouses, unmarried children (under 21 and over 21), and married children (over 21) of green card holders, along with their spouses and any minor children.

  • Third Preference: Married sons and daughters (over 21) of U.S. citizens, along with their spouses and any minor children.

  • Fourth Preference: Siblings of U.S. citizens (over 21), along with their spouses and any minor children.

Wait times for Family Preference visas can vary significantly depending on the visa category and the country of origin. Generally, visas for unmarried children of U.S. citizens (First Preference) have shorter wait times compared to visas for other categories.
